2. PURPOSE

These terms and conditions are intended to expressly regulate the contracting processes carried out by users—hereinafter referred to as “students”—of the distance learning course offered by Lleida Global Solutions S.L. through its website www.mapibosch.com.

These conditions shall remain in effect and valid for as long as they are accessible through the website, without prejudice to Lleida Global Solutions S.L. reserving the right to modify the general terms and conditions, as well as any other legal texts found on said website. In any case, students will be informed of any new conditions.

Students are subject to the general terms and conditions in force at the time of each specific enrollment. No service may be contracted without prior acceptance of these general terms and conditions. Even if the enrollment takes place via a third-party website, these conditions shall still apply by mere acceptance. Upon acceptance, the user shall be considered a student for all purposes.

The course offered is not an officially accredited or regulated educational program.

3. PARTIES INVOLVED

The electronic contracting process carried out through the website shall be executed between the “student” and Lleida Global Solutions S.L.

A “student” of the Mente Libre section of the website shall be understood to be any natural or legal person who registers using the designated form by providing their full name, address, city, country, state, ID number, postal code, and email address, and who has completed the corresponding payment to gain access to the course.

4. RIGHT OF EXCLUSION

Lleida Global Solutions S.L. reserves the right to refuse admission, deny, or withdraw access to the website and/or the services offered, with prior notice and either on its own initiative or at the request of a third party, to those users who fail to comply with these General Terms and Conditions or engage in any of the behaviors outlined in section 11 of these Terms and Conditions.

5. RESULTS DISCLAIMER

Lleida Global Solutions S.L. shall not be held responsible for the success or failure of users in applying the information provided on the website or through the services offered by MAPIBOSCH.COM. The user is solely responsible for how they apply what they have learned from the material provided by MAPIBOSCH.COM.

The content provided is for informational purposes only. At no time does MAPIBOSCH.COM intend to replace personalized professional advice that the user, client, or participant may require in a specific matter. 6. ELECTRONIC CONTRACTING PROCESS

The student will be able to access the distance learning course content online through a website once they receive their username and password.

The training price will be set according to the current applicable rates.

The electronic contracting process will be divided into three steps:

1. The client completes the payment through the checkout process.

2. Once the payment is completed and the terms and conditions are accepted, the student will receive a welcome email confirming their enrollment.

3. Within a maximum of 24 hours, the student will receive an email with access to the virtual academy, valid for 12 months from the date of purchase.

After this period, the student will no longer be able to access the platform by any means.

7. ECONOMIC CONDITIONS AND METHOD OF PAYMENT

Regarding the payment methods for the Unbound Mind Course, payment will be made through the STRIPE platform using any of the following methods:

• Visa/Mastercard: The user must provide the cardholder’s name, card number, expiration date, and CVV.

8.1 INTELLECTUAL AND INDUSTRIAL PROPERTY

Lleida Global Solutions S.L., either directly or as assignee, owns all intellectual and industrial property rights of its website, as well as the elements contained therein (including but not limited to images, sound, audio, video, software, or texts; trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), all owned by Lleida Global Solutions S.L. All copyright rights are reserved.

Any use not previously authorized by Lleida Global Solutions S.L. will be considered a serious infringement of the author's intellectual or industrial property rights.

Reproduction, distribution, and public communication, including making available, of all or part of the content of this website, associated trademarks, the entire course content, as well as the training provided during it, or content published on channels used or made available to the student (such as Zoom, YouTube, Instagram, and WhatsApp this list being merely illustrative and not exhaustive or exclusive), for commercial purposes or any other purpose, by any means or technical support, without the authorization of Lleida Global Solutions S.L., is expressly prohibited.

The student agrees to respect the Intellectual and Industrial Property rights owned by Lleida Global Solutions S.L. The student may only view videos with theoretical content and may not print, copy, or store them on their computer’s hard drive or any other physical medium. The student must refrain from removing, altering, circumventing, or manipulating any protection device or security system installed on Lleida Global Solutions S.L.’s pages.

8.2 Prohibition of so-called “Joint Purchases” or Piracy

What are so-called joint purchases?

This refers to an illegal practice carried out by several people who group together to acquire a digital service or product in order to save costs on the final price. In this case, it would consist of a single person making the payment for the online distance course, but then sharing access with others who engage in this practice, allowing multiple people to access the course using the same password and email.

It is strictly prohibited to share the license for use with other people. Each license is personal and non-transferable. We reserve all civil and criminal actions available to us to protect our rights, all under the warning that this constitutes a crime against intellectual property according to articles 270 and following of the Criminal Code, with penalties of up to 4 years imprisonment.

Any breach of the provisions of this clause will be considered a serious breach of contract.

A duly substantiated mere suspicion of joint purchase allows Lleida Global Solutions S.L. to deny access to the platform for the time necessary to effectively resolve the issue.

9. RIGHT OF WITHDRAWAL

Both the Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (hereinafter, “TRLGDCU”), and Directive 2011/83/EU of the European Parliament and of the Council of October 25, 2011, on consumer rights define the concept of the right of withdrawal and other related concepts, and establish and set the procedures for its exercise.

Based on the above, the STUDENT, by accepting these terms and conditions, expressly agrees that they will not be able to exercise said right of withdrawal once fourteen calendar days (for the Mente Libre Course) have passed since the full payment or the payment of the first installment if this is the chosen payment method.

MECHANISM TO EXERCISE THE RIGHT OF WITHDRAWAL

The right of withdrawal may be exercised by sending an email to mapi@mapibosch.com with the subject line “return of the Mente Libre program.” If applicable, the refund will be processed within 7 calendar days from the date such communication is made.

10. EXEMPTION FROM LIABILITY

Lleida Global Solutions S.L. cannot guarantee the technical continuity of the Website, the absence of failures or service interruptions, nor that the Website will be available or accessible one hundred percent of the time due to causes beyond the control of the website or unforeseen and/or force majeure causes, viruses, cyber-attacks, and/or actions by third parties that cause total or partial impossibility of service provision, as well as other unforeseeable causes such as the incorrect functioning of the internet.

In these cases, nothing may be claimed or demanded from Lleida Global Solutions S.L. for any damages caused.

11. PERSONAL DATA PROCESSING

All information containing personal data provided during the contracting process will be stored by Lleida Global Solutions S.L., in its capacity as data controller, for the purposes of executing this contract. To exercise rights of cancellation, rectification, opposition, deletion, limitation of processing, portability, among others granted by Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights, the student may refer to our privacy and personal data protection policy by contacting mapi@mapibosch.com.

The user agrees that all their personal data may be fully transferred to Sequra and/or Redsys from the moment the user initiates the contracting of the payment service. In the case of Sequra, this occurs when selecting the deferred payment service offered by the latter. This acceptance extends to third parties that may need to access the files for the proper execution of the contract.

12. CAUSES FOR TERMINATION OF THE CONTRACT

The termination of the contract will take place:

1.- For compliance with the terms and deadlines: that is, upon completion of the chosen course.

2.- At any time, unilaterally, due to serious breach of the agreement’s conditions.

Lleida Global Solutions S.L. may terminate or suspend any and all Services contracted with Lleida Global Solutions S.L. immediately, with prior notice, if the student fails to comply with the conditions set forth herein.

Upon termination of the contract, the student’s right to use the Services will cease immediately.

Causes for unilateral termination of the contract by Lleida Global Solutions S.L. include bad faith or serious breach of the contract conditions. Serious breaches of the contract conditions, in addition to those specified within the contract text, include the following:

• Falsification, in whole or in part, of the data provided during the contracting process of any service.

• Altering, circumventing, performing reverse engineering, decompiling, disassembling, or modifying in any way the security technology provided by Lleida Global Solutions S.L.

• False and unfounded opinions, insults, defamation, and/or slander with the intent to discredit the owner of the products or services acquired and/or any personnel belonging to Lleida Global Solutions S.L., as well as any course companions.

• Any breach established throughout these conditions.

Termination implies the loss of rights to the contracted service, as well as of any amounts paid as the price.

This unilateral termination due to actions contrary to good faith or serious contractual breach will not entitle the breaching party to any refund of amounts due or paid, nor to any compensation, with Lleida Global Solutions S.L. retaining all rights to pursue any legal actions available to recover damages and fully compensate for any harm caused.

13.LANGUAGE

The language of these terms and conditions and of the website is Spanish (Spain) and English.

14. APPLICABLE LAW AND JURISDICTION

The relationship between Lleida Global Solutions S.L. and the student shall be governed by the current Spanish legislation, and any dispute shall be submitted to the Courts and Tribunals of the city of Tarragona, unless the applicable law provides otherwise.
